CENTS INNOVO Disclosure Form:

Thank you for your interest in CENTS' online debtor education class/personal financial management instructional course. This is CENTS' fourth curriculum designed for adults. A new bankruptcy law went into effect on October 17, 2005. The law requires consumers seeking bankruptcy protection to participate in a credit counseling class before filing bankruptcy and a debtor education class after filing bankruptcy. The United States Trustee (UST), a branch of the United States Department of Justice oversees the program and maintains a list of approved providers. The United States Trustee has reviewed and approved CENTS' credit counseling services and its personal financial management instructional services under 11 USC 111(d). The United States Trustee has not reviewed or approved any other services that CENTS provides. Approval does not endorse or assure the quality of a provider's services.

Timing of course: To comply with the UST's requirements, you cannot take CENTS' personal financial management instructional course until AFTER your case has actually been filed with the court and you have a case number. If you have not actually filed and do not have a case number, do not take this course yet. If you take this course before you receive a case number from the court, your certificate of course completion will not be valid. Again, there are two bankruptcy courses: 1) a credit counseling class before filing bankruptcy (also called a pre-filing class) and 2) a debtor education course after you file bankruptcy and have a case number. This second course is also called a personal financial management instructional course, a post filing course, and/or a pre-discharge course. Please take special care not to confuse these two classes and ask us if you have questions.

RECEIVING A CERTIFICATE FROM CENTS:

You will receive a certificate of course completion if you finish the course within three business days. To finish the course, you must complete our online class. You must also complete a brief test on the Internet. The test requires that you provide the Code Words. One Code Word will appear during each section of the video. You will be asked to provide the code word to advance. This is to ensure you completed the course as designed. If you score 70% or below on the test, you will be given additional instructions to complete the course.

Privacy policy: CENTS will not sell your information. CENTS will also not share your information, unless legally required to do so. CENTS may disclose your information to the UST in connection with the UST's oversight of CENTS. All information gathered will be strictly safeguarded and stored in a safe manner. We will limit the mandatory collection of information to the minimum required to provide necessary services, which includes performing assessments of your financial situation, determining the factors that led to your financial problems, assistance in preparing a budget, analyzing the budget and providing tips, performing a debt analysis, and informing you of the various alternatives to your financial situation without incurring a negative amortization of debt.

Information collect by CENTS is treated as confidential. No personally identifiable information will be released to any outside person or to any company unless required to do so by law or expressly authorized to do so by you or your attorney. CENTS will never share information with any creditor, collection agency, or credit reporting agency. We will not sell, rent, loan, lease, or trade your contact information or email. CENTS reserves the right to collection information regarding the use of its website and educational program.

Impact on your credit report: CENTS does not provide any debt management plans, debt or credit repair services, or contact creditors on behalf of clients. CENTS has no impact on your credit reports. We do not report any information to any credit reporting agency or bureau. Please note: bankruptcy or some credit counseling plans, including debt management plans, will affect your credit report.

No Contract: you will not enter into a contract with CENTS.

This financial education class will last two hours and will help you better understand your current financial situation and options for your next steps. We will also answer any questions you have.

Instructor qualifications: The program was designed by CENTS Executive Director Anthony Leahy. He has designed several online and multimedia educational programs, including Innovo: reconstructing your finances after bankruptcy; Debt Slapped; Debt Slapped Grad; and Smart Borrowing. He received his Juris Doctor from the University of Washington School of Law in 2001 and has worked for CENTS since 2002.

We want you to take control of your financial situation. We are not responsible for any financial decisions you choose to make. Again, please note that we do not offer debt management plans, debt or credit repair services, or contact creditors on behalf of clients.

Process: Client must complete instruction to receive a certificate. Upon completion of this course, you will fill out a certificate registration page. CENTS will then provide you or your attorney with a certificate of course completion. It will be your responsibility to make sure you receive the certificate. Allow three business days. If you do not receive your certificate by the end of three business days, it will be your responsibility to contact us. If you have CENTS email you the certificate, it will be your responsibility to file the certificate with the court or provide to your attorney to file with the court. CENTS does not file the certificates for you. We will email the certificate to you and/or directly to your attorney if you provide your attorney's address in the certificate registration form.

False statements: You certify that all of the information you provide is true, correct and complete and made in good faith. You understand that knowingly making false or fraudulent statements or misrepresentations about your identity or completion of this course is a violation of the requirements of Federal Law. You must declare under the penalty of perjury that you personally completed this course. By signing in and signing out with your unique sign in, you are declaring- UNDER PENALTY OF PERJURY- that you provided true and correct information and that you took the full debtor education course.

Fee Schedule: CENTS is committed to providing a quality class. The fee is $20 per individual or $25 for joint filers.

Fee Waiver: Any debtor who does not opt out of providing financial records and information will be considered for a fee waiver. Every debtor also has the option to opt out of providing financial income information. A decision will be made on a case-by-case basis and the class will be made available regardless of the client's ability to pay. Please provide Consumer Education and Training Services ("CENTS"): 1) a line item list of each source of your monthly income, listing all your sources of income and how much you receive on a monthly basis from each source); 2) a total of your monthly gross income (be sure to include all income); 3) if married, a total of your spouse's monthly gross income (be sure to include all income); 4) your place of employment; 5) Your most recent pay stub, 6) if married, your spouse's place of employment, 7) if married, your spouse's most recent pay stub; 8)your name, phone number, and email, and 9) the class you want to take (the pre-filing credit counseling or post-filing debtor education). 10) Please email the information to CENTS at tony@centsprogram.org. A client will receive a fee waiver if the annual household income is less than 150% of the Federal Poverty Guidelines issued by the Department of Health and Human Services. CENTS' mission is to help people take control of his or her finances. CENTS offers its services without regard to ability to pay.

Source of Funding: CENTS does not receive any funding from any agency. CENTS is a 501(c)(3) non-profit organization and it receives its funding through foundation grants, special fundraising events, individual donors, and program fees. Please note CENTS does not pay or receive fees or other consideration for the referral of debtors.

Please note: filing bankruptcy, consolidating debt, or entering into a debt management plan may negatively impact your credit reports. You should talk to a licensed professional, such as a consumer or bankruptcy attorney, for more information.

Services offered in languages other than English: CENTS' class is in English. If you have limited English proficiency, we recommend you take the debtor education/personal financial management instructional course with a provider that offers the class in your proficient language. We will refund your payment if we or you determine you cannot understand our class and you will seek the class and certificate from another provider.
